TERMS OF SALE, LIABILITY WAIVER & DELIVERY POLICY

By purchasing products from Setti Fireworks USA, either in-store or online, the customer acknowledges having read, understood, and accepted the following Terms and Conditions of Sale, Safety Guidelines, Liability Waiver, Privacy Policy, and Delivery Policy.

1. COMPLIANCE WITH FLORIDA LAW

The purchase of any products sold by Setti Fireworks USA is strictly limited to individuals who are at least eighteen (18) years of age.

The sale and use of fireworks in the State of Florida are governed by Chapter 791 of the Florida Statutes, including Florida Statutes §§791.07 and 791.08.

Certain consumer fireworks may lawfully be used for recreational purposes on:

  • July 4 – Independence Day
  • December 31 – New Year’s Eve
  • January 1 – New Year’s Day

At other times of the year, fireworks may only be used for purposes permitted by Florida law, including applicable agricultural and other statutory exemptions.

The purchaser is solely responsible for determining whether the use of fireworks is lawful at the intended location and for complying with all applicable federal, state, county, municipal, and emergency regulations, including temporary burn bans or restrictions.

Setti Fireworks USA does not provide legal advice and does not guarantee that fireworks may lawfully be used in every location within the State of Florida.

Fireworks are inherently dangerous products and must always be handled with care, common sense, and respect.

By purchasing, possessing, transporting, storing, or using fireworks purchased from Setti Fireworks USA, the customer voluntarily assumes all risks associated with such products.

To the fullest extent permitted by law, Setti Fireworks USA and Italian Plenitude LLC d/b/a Certified Works, including its owners, officers, employees, agents, representatives, suppliers, and affiliates, shall not be liable for any damages, injuries, losses, claims, or expenses arising from:

  • misuse of fireworks;
  • unlawful use of fireworks;
  • failure to follow product instructions;
  • improper storage or transportation;
  • failure to maintain safe distances;
  • negligence of the purchaser or third parties;
  • use while under the influence of alcohol, drugs, or medications;
  • temporary burn bans, emergency orders, or governmental restrictions.

The purchaser expressly agrees to release and hold harmless Setti Fireworks USA and Italian Plenitude LLC d/b/a Certified Works from any and all claims arising from the purchase or use of fireworks.

Customers must:

  • read and follow all product instructions;
  • use fireworks outdoors only;
  • keep water or a fire extinguisher nearby;
  • supervise minors at all times;
  • maintain appropriate safety distances.

For aerial fireworks, including Reloadable Artillery Shells, Rockets, Canister Shells, and Multi-Shot Cakes, the recommended minimum spectator distance is:

120 feet (36 meters).

Never use fireworks while consuming alcohol, using drugs, or taking medications that impair judgment or coordination.

All sales are final.

No returns, exchanges, or refunds will be accepted.

No refunds shall be provided because of:

  • burn bans;
  • emergency restrictions;
  • weather conditions;
  • governmental orders;
  • inability to use the products after purchase.

Inventory may change rapidly, especially during holiday periods.

If an ordered product becomes unavailable, Setti Fireworks USA reserves the right to substitute the product with an item of equal or greater value.

Customers are responsible for providing a valid and reachable telephone number and email address.

Minimum order for delivery (Delivery is free. Tips are always appreciated):

Independence Day Deliveries

Orders must be received on or before:

July 1 of each year.

Orders placed after July 1 must be picked up at the Port Charlotte store

New Year’s Deliveries

Orders must be received on or before:

December 26 of each year.

Orders placed after December 26 must be picked up at the Port Charlotte store.

Delivery Suspension Periods

Home delivery service is suspended:

  • July 2 through August 20;
  • December 28 through January 15.

During these periods, orders are still accepted but must be picked up at the Port Charlotte store by appointment.

Because fireworks are regulated products, Setti Fireworks USA may retain customer information, including contact information and identification documents, for:

  • order processing;
  • legal compliance;
  • fraud prevention;
  • product recalls;
  • safety notices;
  • important communications relating to purchased products.

Customer information will not be sold to third parties.
